PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL
RIGHTS.
ASSUMPTION OF RISK: I understand and acknowledge that participation in swimming
lessons and related aquatic activities involves inherent risks, dangers, and hazards including
but not limited to: drowning, slip and fall accidents, collisions with other participants or
objects, equipment failure, inadequate supervision, and the negligence of other participants. I
voluntarily assume all such risks and dangers associated with participation in swimming lessons.
RELEASE OF CLAIMS: In consideration for being permitted to participate in
swimming lessons provided by Jennifer (JJ) Mendiola, I hereby release, waive, discharge, and
covenant not to sue Jennifer (JJ) Mendiola, her employees, agents, representatives, and assigns
(collectively "Released Parties") from any and all liability, claims, demands, actions, and
causes of action whatsoever arising out of or related to any loss, damage, or injury, including
death, that may be sustained by the participant while participating in swimming lessons or while
on the premises where the activity is conducted.
INDEMNIFICATION: I agree to indemnify and hold harmless the Released Parties
from any loss, liability, damage, or costs, including court costs and attorney fees, that they
may incur due to participation in swimming lessons, whether caused by the negligence of the
Released Parties or otherwise.
PREMISES LIABILITY: I understand that swimming lessons are conducted at the
residential property owned by Jennifer (JJ) and Magahet (Gar) Mendiola, located at 853 Mirage
Ct. Newbury Park, CA 91320 ("Premises"). I acknowledge that I and any family members, guests, or
other individuals accompanying me to the Premises (whether or not participating in swimming
lessons) do so at our own risk. I agree to release, waive, discharge, and covenant not to sue
the Released Parties and the property owners from any and all liability, claims, demands,
actions, and causes of action for any loss, damage, or injury (including death) that may occur
on or about the Premises, including but not limited to injuries from slipping, falling,
collisions, pool equipment, landscaping, structures, or any other hazards present on the
property. This release applies to all persons accompanying me, regardless of their participation
in swimming activities.
MEDICAL TREATMENT: I authorize the Released Parties to provide emergency
medical treatment if necessary. I understand that the Released Parties assume no responsibility
for any injury or damage which might arise out of or in connection with such authorized
emergency medical treatment.
PHOTOGRAPHY/VIDEO CONSENT: I consent to the use of photographs and video
recordings of the participant taken during swimming lessons for promotional and educational
purposes by Jennifer (JJ) Mendiola.
PARENTAL/GUARDIAN AUTHORITY: I represent that I am the parent or legal guardian
of the participant(s) listed in this registration and have the legal authority to enter into
this agreement on their behalf. I agree that this release shall be binding upon the
participant's heirs, executors, administrators, and assigns.
SEVERABILITY: If any provision of this agreement is held to be invalid or
unenforceable, the remaining provisions shall continue to be valid and enforceable.
GOVERNING LAW: This agreement shall be governed by the laws of the State of
California. Any legal action arising out of this agreement shall be brought in the courts of
California.
I HAVE READ THIS RELEASE AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND
THAT I AM GIVING UP SUBSTANTIAL RIGHTS INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM
SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY.
